This is a liability waiver, release of claims, and assumption of risk.

Organizer: NoCo Whips LLC and Higer Elevation Powersports LLC.

Please read this waiver carefully. By submitting this form, you acknowledge that you understand and agree to all terms and conditions listed below. This form serves as a legally binding digital signature.

1. ACKNOWLEDGMENT OF RISK

I understand and acknowledge that participation in the Taylor Park UTV Rally 2026 in an off-road UTV (Utility Task Vehicle) event involves inherent risks, including but not limited to: vehicle rollovers, collisions, equipment failure, uneven terrain, weather conditions, wildlife encounters, serious bodily injury, permanent disability, paralysis, or death. I voluntarily choose to participate with full knowledge of these risks.

2. ASSUMPTION OF RISK

I knowingly and freely assume all risks, both known and unknown, foreseeable and unforeseeable, related to my participation in Taylor Park UTV rally 2026, even if arising from the negligence of the Released Parties (defined below) to the fullest extent permitted by law.

3. RELEASE AND WAIVER OF LIABILITY

In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue the Taylor Park UTV Rally 2026 event organizers (NoCo Whips LLC and Higher Elevation Powersports LLC), owners, sponsors, volunteers, employees, landowners, affiliates, and agents (“Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in or traveling to/from the event.

4. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation, including attorney fees, whether caused by my actions or those of others.

5. SAFETY & RULES

I agree to:

Follow all event rules, safety instructions, and local/state laws

Operate a UTV only if legally permitted and physically capable

Wear required safety gear (including helmet, seatbelt, etc.) if required by state laws.

Refrain from operating a vehicle under the influence of drugs or alcohol

Failure to comply may result in removal from the event without refund.

6. MEDICAL CONSENT

I consent to receive medical treatment deemed necessary in the event of injury or emergency and agree to be financially responsible for any medical services provided.

7. EQUIPMENT & VEHICLE RESPONSIBILITY

I acknowledge that I am solely responsible for the condition, operation, and maintenance of any UTV I operate or ride in during the event.

8. PHOTO & VIDEO RELEASE

I grant permission for the event organizers to use photographs or videos of me taken during the event for promotional or marketing purposes without compensation.

9. MINORS

If the participant is under 18 years of age, a parent or legal guardian must sign below, agreeing to all terms on behalf of the minor.

10. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado.

11. SEVERABILITY

If any portion of this waiver is held invalid, the remaining portions shall continue in full legal force and effect.
